Scott D. Deatherage
Attorney at Law
We understand the multiple issues that arise with permitting new or existing facilities. Working with governmental agencies, state and local taxing authorities and economic development entities, and neighboring landowners raising objections, among others, we assist clients in obtaining permits and obtaining economic development incentives and tax abatement so their projects can be completed.
Businesses require guidance on regulation and its impact on their operations. We offer expert advice as to what the regulations require and how to develop a sound and reasonable approach to compliance.
Disputes occur-- with governmental agencies, neighbors, and other businesses. We understand the players, the interplay of tort law and environmental law, and how to resolve disputes.
We have advised clients regarding hundreds of transactions. The experience includes due diligence, contractual negotiations involving indemnities, representations and warranties, environmental escrow and remediation agreements, review and commenting on Phase I and Phase II Environmental Site Assessment Reports. We work with clients, consultants, and counterparties to resolve issues and close transactions.
Scott Deatherage focuses his practice on the environment, energy, and water. Often these issues overlap and require a multi-level resolution. He advises clients how to resolve legal and business issues in what are often complex problems and transactions.
The key for this practice is knowledge, experience, creativity, innovation, and judgment.
